USA: EO on Preventing Access to Sensitive Personal and Government Related Data - Breaking Down the Impact on Transfers for Businesses
Cybersecurity attorney Mark Francis spoke with OneTrust DataGuidance about the White House's recent Executive Order (EO) aimed at preventing access to personal and government data by certain foreign countries. Mr. Francis noted the EO's potential impact on technology and telecommunications companies that facilitate global data transfers, as well as data brokers. He also discussed implications for the EU-US Data Protection Framework and advised businesses to assess how third parties are using and transferring data to avoid risking access by restricted nations.
"The EO is a big boost for the NIST Cybersecurity and Privacy Frameworks, since businesses may be more directly required to implement those frameworks through the requirements that CISA adopts under the EO," he commented. "Many businesses are already aligning with these frameworks but should take this EO as a strong indication to accelerate that transition if they haven't done so yet."
