Intellectual Property attorney Juana Cajiao Reina was interviewed by Asuntos Legales about the complex legal challenges posed by cybercrimes committed through artificial intelligence (AI). As AI technology advances, new methods of fraud and impersonation, such as deepfakes and cloned audio, have emerged, making it essential to establish regulations to protect image rights and prevent crimes. Ms. Cajiao emphasized the importance of these rules in legally addressing the misuse of personal images.
"The right to one's image is protected by the Constitution and the Civil Code, which stipulate that unauthorized use of a person's image can lead to legal action for damages. Furthermore, if deepfakes are used for extortion or fraud, they would be classified as crimes," she stated.
