The Trademark Naturalven Was Registered by the SIC Despite Opposition Presented by Natura
Intellectual Property attorney Danilo Romero commented for Asuntos Legales about the registration of the trademark Naturalven in Colombia. Brazilian multinational cosmetics and beauty products company Natura opposed the mark, arguing it was too similar to its own sign, which would confuse a consumer. However, the Superintendency of Industry and Commerce (SIC) declared the opposition unfounded, concluding the opposing mark did not have sufficient distinctiveness or notoriety. Mr. Romero offered his opinion on the decision.
"Even though the evocative marks are well-known, what should come first is the risk of confusion and association that affects the reputation in the market, and if that is not the case, the registration is valid," he affirmed.
