January's DEI Executive Orders Will Have Impact for Years to Come

Partner O'Kelly E. McWilliams III was quoted in a SHRM article about the significant impact of recent executive orders on diversity, equity and inclusion (DEI) initiatives within federal contracting. These orders, issued in January, aim to eliminate DEI programs and preferences in the federal government's employment and contract practices and foster a return to merit-based opportunities. They have presented challenges for contractors, who must navigate these changes while adhering to existing civil rights laws and affirmative action requirements for veterans and individuals with disabilities.

Government contractors are "waiting for guidance on what is legal DEI," Mr. McWilliams noted. He also cautioned that the heightened scrutiny "raises the bar" for potential risks, particularly concerning the False Claims Act.
