Santander Labor Union Committees Defended the Separation of Powers

Labor and employment attorney Camilo Cuervo was interviewed by Vanguardia about the possibility of implementing parts of the labor reform by decree, following the project's stagnation in Congress. Mr. Cuervo emphasized that many of the proposed modifications must go through the legislative process, as a decree cannot replace or modify existing laws. Therefore, changes to aspects such as night shifts and apprenticeship contracts could not be implemented solely through decrees.
"Most cannot be issued by decree. They have to pass through Congress and become law because what is regulated by law cannot be changed by a regulation of a lower category, and decrees are inferior to laws," he explained.
