Coal Industry Cheers Trump's Pause on Stronger Pollution Rules
Environmental and regulatory attorney Zach Pilchen was quoted in a Bloomberg Law article discussing the legal complexities surrounding President Donald Trump's order that eases U.S. Environmental Protection Agency (EPA) air toxics rules. Mr. Pilchen explained that the Clean Air Act (CAA) provides the president with an atypical level of involvement in regulating these hazardous pollutants, a task that generally falls under the agency's jurisdiction. This unusual delegation of authority raises potential legal challenges because of its departure from standard regulatory processes.
"It's an unusual part of the Clean Air Act because it expressly gives the president a role in the regulation of hazardous air pollutants, whereas typically those are decisions made by the EPA Administrator," he said.
