Prototype Cases of Dismissal of Legal Personnel

Corporate Services attorney Sergio Alayón wrote an article for Lexir about Colombia's Supreme Court of Justice's ruling that established some prototype cases of legal dismissal of companies in the country. Mr. Alayón explains that the court recalled the importance of the patrimonial separation between the legal entity and its partners. However, it pointed out that in cases where the company is used as an instrument to defraud the law causing damage to third parties, the lifting of the corporate veil is the basis that allows extending the responsibility to the partners who have participated in the events. He also highlights the list of prototype cases where the company is used as an instrument to evade legal provisions or fraud the law.
