Navigating PFAS Compliance With FDA, Emerging State Laws

Environmental attorneys Robert Frank, Michael Fiorillo and Dianne Phillips, co-authored a Law360 article about how federal agencies and states are taking the lead in establishing regulatory regimes for per- and polyfluoroalkyl substances (PFAS). The U.S. Environmental Protection Agency (EPA) has been active in issuing regulations, but the U.S. Food and Drug Administration (FDA) has also conducted studies on PFAs transferring from containers to food. The FDA has requested scientific data on PFAS in food containers, but no federal regulations have been proposed yet, creating uncertainty about how future agency actions might affect state laws and business compliance.
