States' Fights: Healthcare Antitrust Bills Return

Healthcare Transactions attorney John Saran was quoted in a Private Funds CFO article discussing proposed healthcare antitrust legislation, including measures addressing private equity, in several states. After the election, he said there was a wave of new initiatives targeting healthcare consolidations across the U.S., including a bill in Indiana "unlike any other statute out there today" that would give the state's attorney general the power to block deals of all sizes. Mr. Saran added that he recommends private equity managers and industry stakeholders remain informed and join the discussion as it affects them.

"If one of those larger states picks up on what Indiana, Oregon or Vermont is proposing, that could have a meaningful impact on your business. It's worth being part of the process. As we saw in the last two years, the states talk to each other," he explained.
