Labor Reform: The Path of Decrees Would Have Multiple Limitations
Labor attorney Camilo Cuervo was cited in an article published by Portafolio examining the options for supporters of Colombia's labor reform after its defeat in Congress. Some members of the government have proposed using decrees to implement some measures, but the effectiveness of this mechanism is limited because the majority of changes have to go through the legislative process. Mr. Cuervo pointed out that what the government can do is establish clearer guidelines on collective bargaining and arbitration procedures, facilitating dialogue between workers and employers without the need for complex legislative changes.
"Analyzing the 84 articles, all, absolutely all of them, implicate an amendment to the law and the creation of new figures that have legal characteristics and that thus have to be passed through a law. I believe that what the government has said is more of a media announcement designed to please its base and supporters in the trenches, but the truth is that it has no real legal significance," he said.
